Organized by Guangzhou Zhongxin Intellectual Property Service Co., Ltd., contracted by Guangzhou Productivity Center and co-organized by Huafa Qixianqin National Intellectual Property Operation Platform, Innopat Intellectual Property Co. Ltd. and Zhuhai Lawyers Association, the “Patent Agency Senior Management Capacity Enhancement Practical Class of 2022” was successfully held for two days in Zhuhai Huaqiao Hotel from Sept.20, and Ms. Duan Shuhua, General Manager of Innopat Intellectual Property Co. Ltd., was invited to be the lecturer of the course and gave a lecture on "Foreign-related IP infringement disputes and 337 investigation coping strategies".
Ms. Duan shared the first successful design patent non-infringement case in Hong Kong, the successful response to the German customs enforcement case and many classical cases related to the printing consumables industry. At the same time, Ms. Duan also made a comparative sharing of the case studies of 337 investigations in different industries such as the electronic communication industry, LED lighting industry, etc.
Combined with claim interpretation and Markman-Hearing, Ms. Duan particularly shared the experience of how we successfully won a fully victory in the 337-1106 case, a case that the U.S. ITC found non-infringement in both the preliminary and final rulings and the U.S. Court of Appeals for the Federal Circuit ruled non-infringement.
By sharing classic foreign-related cases and coping strategies, we provided practical and feasible suggestions for enterprises to better understand and respond to foreign-related IP risks, which makes the course warmly praised by the attendees.
